Morndale – Terms of Service

Welcome to Morndale. By accessing or using Morndale (including the game client, website, forums, and any related services), you agree to be bound by these Terms of Service. If you do not agree, you may not use Morndale.
1. Acceptance of terms
By creating an account, accessing the game, or using any Morndale services, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.
2. Eligibility
Morndale is not intended for children under 13. If you are under the age of 18 (or the age of majority in your region), you may only use Morndale with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
3. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly if you suspect any unauthorized use of your account.
We reserve the right to refuse registration, reclaim usernames, or terminate accounts that violate these Terms or pose a security risk.
4. Early access, testing, and game changes
Morndale may be in active development, early access, or open testing. Features may change, break, or be removed at any time. Game progress, items, and other data may be reset as part of development, testing, or maintenance.
You acknowledge that Morndale may contain bugs, downtime, and incomplete features, and you agree that your use is at your own risk.
5. Fair play and code of conduct
You agree to use Morndale in a respectful and lawful manner. This includes, but is not limited to:
- No harassment, hate speech, threats, or targeted abuse.
- No cheating, botting, exploiting bugs, or using unauthorized third-party tools.
- No attempts to disrupt servers, reverse engineer, or interfere with the game’s operation.
We may suspend or terminate accounts, remove content, or take other moderation actions at our discretion if we believe these rules have been violated.
6. Virtual items and game content
Morndale may include virtual items, currencies, or progression systems. You acknowledge that:
- Virtual items and currencies have no real-world monetary value.
- You do not own virtual items; you receive a limited, revocable license to use them within Morndale.
- We may modify, rebalance, or remove items, features, or progression at any time.
7. Purchases and refunds
If Morndale offers paid content, in-game purchases, or other paid services, all sales are generally final and non-refundable, except where required by applicable law or explicitly stated otherwise at the time of purchase.
We are not responsible for unauthorized purchases made through your account. Please secure your payment methods and account credentials.
8. User content and feedback
You may be able to submit content (such as messages, usernames, feedback, or other materials) in connection with Morndale. You are responsible for the content you submit and must ensure it does not violate any laws or third-party rights.
By submitting content or feedback, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and display that content in connection with operating and improving Morndale.
9. Intellectual property
All rights, title, and interest in Morndale, including game assets, artwork, code, design, and branding, are owned by the Morndale team or its licensors. You receive a personal, limited, non-transferable, revocable license to access and use Morndale for personal, non-commercial purposes.
You may not copy, distribute, modify, or create derivative works from Morndale content without our prior written permission, except where permitted by law.
10. Privacy and data
Our collection and use of personal data are described in our Privacy Policy. By using Morndale, you consent to the collection and use of your information as described there.
11. Disclaimers
Morndale is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that Morndale will be uninterrupted, secure, or error-free, or that any defects will be corrected.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, the Morndale team and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of Morndale.
Our total liability to you for any claims arising out of or relating to Morndale will be limited to the amount you have paid us (if any) in the twelve (12) months preceding the claim, or the minimum amount permitted by applicable law if greater.
13. Termination
We may suspend or terminate your access to Morndale at any time, with or without notice, if we believe you have violated these Terms, pose a security or legal risk, or if we discontinue the service.
Upon termination, your right to access Morndale will immediately cease. Some provisions of these Terms will continue to apply even after termination, including those relating to intellectual property, disclaimers, and limitations of liability.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of Morndale after changes take effect constitutes your acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or Morndale will be subject to the exclusive jurisdiction of the courts located in New York, USA, unless applicable law requires otherwise.
